1. About This Agreement

These Terms of Service (“Terms”) govern your use of Aussie Tax Genius (“we”, “us”, “our”), operated as a sole trader business at aussietaxgenius.com (“the Service”). By creating an account or using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.

2. What We Provide

Aussie Tax Genius is an online invoice generation tool that helps Australian businesses create invoices. We are a software tool only. We are not:

  • A registered tax agent
  • A financial adviser
  • An accountant or bookkeeper
  • A legal adviser

Nothing on this platform constitutes tax, financial, or legal advice. You should consult a registered tax agent or accountant for advice specific to your circumstances.

3. Your Responsibility for Compliance

You are solely responsible for:

  • Ensuring the accuracy of all information you enter into the Service
  • Verifying that invoices generated meet your specific ATO obligations
  • Downloading, saving, and retaining copies of your invoices for the period required by law (currently a minimum of 5 years under ATO requirements)
  • Your own tax compliance, GST reporting, and BAS lodgement
  • Ensuring your ABN and GST registration status are correct

We are a convenience tool. We do not guarantee that invoices generated meet your specific legal requirements. Always verify with a registered tax agent.

4. Data Storage and Automatic Deletion

We store minimal data to operate the Service. Specifically:

  • Invoice PDF files are stored temporarily on our servers for up to 24 hours after generation to allow you to download them. They are then automatically and permanently deleted from our servers.
  • Invoice records (invoice number, date, amounts) are retained in our database for up to 90 days to allow you to view your invoice history, after which they are permanently deleted.
  • Account data (name, email, ABN) is retained for as long as you maintain an account with us.

You must download your invoice immediately after generation. We do not provide long-term storage of your invoices. We accept no responsibility for invoices that are not downloaded and saved by you.

5. Account Termination and Data Deletion

You may request deletion of your account and all associated data at any time by emailing hello@aussietaxgenius.com. Upon receiving your request we will permanently delete your account and all associated data within 30 days. Note that once deleted, this data cannot be recovered.

We reserve the right to terminate accounts that violate these Terms, are used fraudulently, or are inactive for more than 24 months. Upon termination, all associated data is permanently deleted.

6. Limitation of Liability

To the maximum extent permitted by Australian law:

  • We provide the Service “as is” without warranty of any kind, express or implied
  • We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements
  • We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service
  • We are not liable for any loss arising from ATO audits, penalties, or compliance failures resulting from invoices generated using this Service
  • We are not liable for any loss of data, including invoices that were not downloaded before automatic deletion
  • Our total liability to you for any claim arising from use of the Service shall not exceed the total amount you have paid us in the 3 months preceding the claim

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

7. Subscription and Payments

  • The Free plan allows up to 3 invoices per calendar month at no charge
  • The Pro plan is billed monthly at the current advertised rate
  • Subscriptions automatically renew each month until cancelled
  • You may cancel at any time from your account settings — cancellation takes effect at the end of the current billing period
  • We do not offer refunds for partial months
  • We reserve the right to change pricing with 30 days notice

8. Acceptable Use

You must not use the Service to:

  • Generate fraudulent or misleading invoices
  • Impersonate another business or individual
  • Enter false ABN or business details
  • Facilitate tax evasion or financial fraud
  • Attempt to reverse engineer, copy, or replicate the Service

Violation of these terms will result in immediate account termination and may be reported to relevant authorities.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
